When is smoking Pot child abuse?

Marijuana is still illegal in Texas and children are taken into CPS custody when parents are caught using it.  Parents are admonished that if they can’t quit, their parental rights could be terminated or restricted.  But, with marijuana legal in some states and foster homes in short supply, it seems CPS is becoming more tolerant of parents who use.  Parents are allowed supervised visits with their children even though they continue to test positive. Are they impaired while in the presence of their children? I don’t think we really know. Perhaps we need to look at pot like we do alcohol: at some point the level of the drug in your system makes you impaired.  And, if you can’t use pot below the impaired level, you can no longer provide a safe environment for your children.
